PSU SURVEY FOR THE YEAR 2012 - 13 IS RELEASED BY DPE.
THE POSITION OF BSNL IS VERY ALARMING.
BSNL TOPS THE TABLE OF LOSS MAKING PSU FOLLOWED BY AIR INDIA AND MTNL.
THE ONLY CONSOLATION IS THAT BSNL STANDS SECOND IN THE TABLE OF TOP TEN PSUs WITH GROSS BLOCK OF 174828.36 CRORES.

Hon'ble High Court Delhi dismissed DoT review application on ITS repatriation case: Hon'ble High Court Delhi today dismissed DoT review application on ITS repatriation case.
DOT filed review application to Hon'ble High Court Delhi pleading that DoT is implementing Hon'ble High Court judgment dated 15.02.2013 for repatriation of ITS officers from BSNL/MTNL immediately & as per the decision of Union Cabinet ITS officers will further be sent on deemed deputation to BSNL/MTNL for the next 10 years. 40 ITS Officers will be repatriated every year in diminishing order progressively.
During these 10 years period, BSNL/MTNL will create their Management at higher level. Our advocate strongly protested against DoT review application & Hon'ble High Court Delhi at first instance itself dismissed the DOT review application & directed to implement Court order in its true spirit.

Based on the pre-revised scale as on 1.1.2007 and revised pay with 68.8% fitment as on 1.1.2007 the calculation for 78.2% fitment benefit is worked out and furnished in the below linked file. The current basic in the year 2012 and the total increase may be seen in the coloured columns. GS, President met GM(Estt.) and discussed (a) Implementation of 78.2% IDA fitment order:
We requested for early submission of MC Note on 78.2% IDA fitment benefit as per the agreement. GM(Estt.) mentioned that MC Note has been finalized by Estt. Section and sent to EF Cell for clearance and after the approval of Competent Authority it will be sent to MC for approval.
(b) Pay anomaly case of departmental JTOs/JAOs:
We expressed our serious concern against non-settlement of the pay anomaly case of departmental JTOs/JAOs. We requested that the pay anomaly of departmental JTOs/JAOs needs immediate settlement by allowing option to them and allowing 5-increments benefit to bring them in the minimum of the E-1A pay scale of JTO.
(c) Antedating of DNI and to removal of pay anomaly wherein seniors are drawing less pay then their juniors:
We resented that despite the direction of CMD / Director(HR), BSNL and Hon'ble High Court Kerala at Ernakulam judgement the pay anomaly cases are not being settled. GM(Estt.) mentioned that the Committee meetings to discuss above issues could not be held for the last one and half month due to continuous leave of GM(EF) and some time Sr. GM(Pers.) is on tour. However, he assured that in the next week on the availability of all the Committee Members the meeting date will be decided to sort out the issues.
(d) Regularization of officiating JTOs: GM(Estt.) mentioned that regularization of officiating JTOs can't be initiated due to pending court cases in Hon'ble Chandigarh High Court and Ernakulam High Court. The case is posted for hearing on 31.07.2012 in Hon'ble Chandigarh High Court and judgement is reserved in Ernakulam high Court.

(a) Implementation of DPE OM dated 2nd April,2009 regarding 78.2% IDA Pay Fitment Case: We requested for giving an early financial concurrence to the Management Committee (MC) Note for implementation of DPE OM 2nd April,2009 regarding 78.2% IDA fitment benefit instead of 68.8%. Director (Finance) mentioned that MC Note on this issue is under consideration and shortly clearance will be given to MC Note.
(b) Affairs of Kerala Telecom Circle wherein AIBSNLEA has been forced to serve a notice of organizational action to protest against the indifferent attitude of Circle administration: We informed Director (Finance) that Kerala Telecom Circle administration with an indifferent and biased attitude is not settling the genuine grievances of our members as already informed to your good self. Director (Finance) mentioned that he has already spoken to CGMT Kerala Telecom Circle on this issue and informed that CGMT Kerala Circle will issue officiating promotion order shortly and appealed to withdraw the scheduled agitation programmes.
(c) DPC from CAO to DGM: We expressed our serious concern against delay in holding DPC from CAO to DGM(F) posts. Director(Finance) mentioned that MC Note for relaxation of eligibility condition for the promotion of CAO to DGM has already been sent to MC for approval and further assured that in tomorrow MC Meeting the same will be put up for approval.
(d) DPC from AO/Sr. AO to CAO: We expressed our serious concern against the delay in DPC from AO/Sr. AO to CAO . Director(Finance) mentioned that still about 30 ACRs are pending and VCRs from about 15 Circles are awaited, he assured that DPC will be conducted soon.
(e) Regularization of Postal JAOs: We requested for Regularization of Postal JAOs as per DoT

KOLKATA: The telecoms department is likely to unveil a higher compensation package by June 30 to help state-owned BSNL and MTNL coax their senior managements, involving some 1000 senior ITS officers to stay back.
Last month, BSNL and MTNL had sought a review of an April 17 Delhi High Court order that required them to release these ITS officers by May 14 as they had all opted to return to government service where pension is higher. Both telcos had claimed such a move would derail them and had sought two years from the high court to defer the ITS repatriation exercise. But the court has given them till September 30.
Since there are no vacancies in the telecom department either to absorb so many executives, the government is working closely with BSNL, MTNL and the Indian Telecom Service Association (ITSA), the body representing ITS officers, to work out a compromise formula that encourages about 900 ITS officers to stay back in BSNL and another 100-odd in MTNL in the long term interest of both telcos. So much so, an internal telecom department panel chaired by joint secretary (telecom) Malay Srivastava is trying to finalise a new compensation package by the month end.
"Efforts are on to encourage these ITS officers to remain in BSNL and MTNL by ensuring they do not lose out on central pension dues," a senior official in the telecom department with direct knowledge told ET.
At present, the high court has fixed August 12, 2005, as the absorption date for ITS officers opting to stay back in either BSNL or MTNL. But in that case, 90 per cent of this ITS bloc which is in BSNL will lose 7 years of central government pension.
Since these central government officers were deputed to BSNL 12 years ago when the telco was spun off into a separate company from DoT, they have already accumulated 12 years of pension dues. But if they opt to retire from government service and seek re-employment in BSNL from August 12, 2005, they will retain barely 5 years of central government pension. Pension earned beyond August 12, 2005, will be as per state PSU scales which is lower than central levels.
"This is the main bone of contention and government is trying to address this urgently. One option is to allow ITS officers seeking absorption in BSNL and MTNL to retire from government service on current date. That way, they get to keep their central pension for the full deputation period, and thereafter earn additional sums as per PSU scale. But there is no decision yet," said a committee member.

(b) Superannuation benefits to BSNL Recruited employees: GM(Estt.) informed that the proposal in this regard has been sent to the Committee, examining the case.
(c) Antedating of DNI: GM(Estt.) informed that this issue has already been discussed once in the Committee Meeting headed by Sr. GM(Pers.) and shortly the Committee will submit its report.

State-owned erstwhile blue chip Bharat Sanchar Nigam (BSNL) has drawn up plans to lease its real estate assets to developers as it looks to recoup revenue and mounting losses.
After the defence and railways, BSNL is the country’s largest landholder. Its properties span 3,500 towns across India worth thousands of crores making it the largest state-owned companies in terms of land assets.

We assured him that we have already appealed to each and every executive and non-executive to concentrate more and more to turn around BSNL and discussed :-
(i) Clarification sought by Kerala circle regarding Officiating Promotion: We requested to give clarification as requested by Kerala Circle regarding officiating promotion in Finance wing. He replied that he had spoken with GM(F) Kerala already and for written reply he would instruct GM(FP).
(ii) DPC from CAO to Adhoc DGM (F) : We expressed our serious concern about delay in conducting DPC to fill up all vacant DGM(F) posts from CAO. He assured that after taking the clearance from Personnel Branch of CO and MC approval DPC will be initiated shortly.
(iii) DPC from AO/Sr AO to CAO (Regular/Adhoc): We expressed our concern regarding delay in DPC to fill up all vacant posts of CAO (Regular/Adhoc) from AO/Sr.AO. Director (F) mentioned that after receipt of missing CRs DPC work will be completed.
(iv) Conducting of JAO Part II Exam: We requested to conduct JAO Part II examination in old pattern early as the Finance wing is facing heavy shortage in JAO cadre. Director (F) assured that date will be announced soon.
(v) Request transfer cases and Vigilance cases: we requested to consider the request transfer cases and early clearance of disciplinary cases in view of ensuing CAO DPC. He assured to look into the matter.
(vi) Regularization of Officiating JAOs case: We requested the Director (F) to regularize all the Officiating JAOs of about 180 as regular JAOs considering their long service as Offg. JAOs as one time measure. He expressed difficulty in the proposal and advised that these JAOs should appear in JAO Part-II exam being held on old syllabus pattern.
(vii) Regularization of Postal JAOs: We requested for early regularization of postal JAOs as the DOT has already given the clarification. Director (Fin) after some discussions assured that in view of the DOT clarification an early action in this regard will be taken.

(a) DPC from DE to DGM: We requested to get early clearance from MC to fill up vacant DGM Posts by giving one time relaxation in the eligible condition to DEs. Sr. GM(Pers.) informed that the proposal is sent to MC for approval and hope that in today's MC Meeting the same will be cleared, which will pave the way to start DPC for the promotion of DE(Regular) to DGM(Engg.). It is understood that the BSNL MC has cleared the proposal of one time relaxation in the eligibility condition.
(b) DPC from SDE(T) to DE(Adhoc/Regular): We requested Sr. GM(Pers.) to initiate DPC to fill up vacant DE(Adhoc/Regular) vacancies. Sr. GM(Pers.) informed that DPC is delayed due to court cases pending in the Hon'ble High Courts at Jabalpur and Chandigarh and advised to get cleared the same at the earliest.
(c) Posting of SDE(T) promoted from JTO(T) LDCE quota: We requested Sr. GM(Pers.) to post SDE(T) recently promoted from JTO(T) LDCE quota at the choice of place. Sr. GM(Pers.) informed that recently they have called options from the promoted SDE(T) for Hard tenure/Tenure places and further informed that they will be posted to the Circle where acute shortage of SDE(T) posts.
(d) Pay anomaly due to antedating of DNI wherein senior drawing less pay than their juniors and Removal of Pay anomaly caused on implementation of EPP, wherein seniors drawing less pay than juniors: We expressed our serious resentment for not settling the case of pay anomaly due to antedating of DNI wherein seniors drawing less pay than their juniors on implementation of 2nd PRC and negative report of committee on removal of Pay anomaly caused on implementation of EPP, wherein seniors drawing less pay than juniors issue despite of the Hon'ble CAT Ernakulam Bench direction to step up the pay of seniors w.r.t. their juniors as per the provision of FR&SR. Sr. GM(Pers.) informed that he will fix the Committee Meetings at the earliest.
(e) Posting on promotion from SDE(TF) to AGM(TF): We requested to give clearance for posting on promotion to AGM(TF) posts as the DPC has been completed more than two months before. Sr. GM(Pers.) mentioned that clearance will be given at the earliest.

ஆனால், BSNL ல் மட்டும் இது நடைமுறைக்கு வரவில்லை.
68.8% சதவீத பஞ்சப்படியை மட்டும் இணைத்து
புதிய அடிப்படை ஊதியத்தை அறிவித்தது.
நிதி நிலையைக் காரணம் காட்டி நிர்வாகம் தொடர்ந்து மறுக்கிறது.
DPE உத்தரவின் படி BSNL 2008 ஆண்டில் லாபம் ஈட்டிய நிறுவனம்.
எனவே 78.2% பஞ்சப்படியை இணைத்து புதிய ஊதியம்
தர மறுப்பதை ஏற்க முடியாது.
இதன் காரணமாக 2009 முதல் இரண்டு ஆண்டுகளாக
ஊழியர்கள் மாதந்தோறும் ஆயிரக்கணக்கான ரூபாய்
இழந்து கொண்டிருக்கிறார்கள்.
பல்லாயிரக்கணக்கான ஊழியர்கள் இந்த இழப்போடு
பணி ஓய்வும் அடைந்து விட்டார்கள்.

நட்டம் தரும் கிராமப்புற சேவைகளை நிறுத்த வேண்டும்.
அல்லது
சேவைதான் குறிக்கோள் என்றால்,
கிராமப்புற சேவைகளுக்கு இழப்புத் தொகையை
அரசு ஈடு செய்ய வேண்டும்!
இவை இரண்டையும் செய்ய மறுக்கிறது அரசு!
தலைமைப் பொறுப்பில் இருக்கும் நிர்வாகமும்
உள்ளே - வெளியே ஆட்டம் ஆடிக்கொண்டு

11.06.2012: Forum of BSNL Unions/Associations talk with CMD BSNL failed. Intensify agitation programme:
In response to Dy. Labour Commissioner directions, CMD BSNL hold a meeting with the representatives of Forum of BSNL Unions/Associations at 4.00 PM in BSNL Board Room to discuss the demands w.r.t proposed indefinite strike w.e.f. 13th June'2012(00:00 hrs). DIR(Fin.), DIR(EB), PGM(SR), GM(EF), GM(Estt), DGM(SR) and AGM(SR) were also present in the meeting.
CMD briefed about the financial condition of BSNL and mentioned that at present it is not possible to consider Forum demands w.r.t implementation of 78.2% IDA fitment benefits & revision of allowances as per 2nd PRC recommendations. After CMD's Meeting representatives of Forum of BSNL Unions/Associations met & discussed to implement successfully indefinite strike from 13th June'2012 at 00.00 hrs.
The Forum of BSNL Unions/Associations representatives felt that BSNL Management is quite indifferent towards BSNL employees whereas ready to give all benefits to the deputationists in BSNL. As Management didn't shown any keenness to resolve the issue, Forum decided to go ahead with the indefinite strike w.e.f 13.06.2012, 00.00 Hrs.
All CHQ Office Bearers, Circle/Branch Secretaries are requested to intensify the agitation call by making indefinite strike from 13th June'2012 (00.00 hrs.) a complete success.

INDEFINITE STRIKE IMMINENT :
There are only three more days for the historic indefinite strike to start. According to reports received by the CHQ, the strike is going to be a hundred per cent success. Spontaneous and massive preparations are going on throughout the country to make the strike a historic success. All the Unions and associations of BSNL are united completely to end the injustice being meted out to the employees. From the Management side there is no honest and worth mentioning attempt to avert the strike. After the 1st June discussion, management has not taken any step to resolve the crises. The conciliation that is going to take place with the Chief Labour Commissioner next Monday is not going to yield any result, unless the management comes forward to settle the issue. Hence, in all probabilities, the indefinite strike from 13th instant has become imminent. Hence, CHQ calls upon all the leaders and cadres to take all out efforts to make the strike a resounding success.

01.06.2012: Agitation Programmes of Forum of BSNL Unions/Associations will continue since the talk with CMD, BSNL failed:
GS, President along with the representatives of Forum of BSNL Unions/Associations attended meeting with CMD, BSNL. Director(EB), Director (Finance), PGM(SR), GM(Estt.), GM(CA), DGM(SR) and AGM(SR) were also present in the meeting.
CMD, BSNL welcomed the representatives and asked to discuss their demands. The representatives of Forum one by one resented and strongly demanded the implementation of DPE orders dated 26th Nov'2008 and 2nd April'2009 and revision of Allowances as per 2nd PRC recommendations and 78.2% IDA fitment benefit in the pay respectively . They also protested against the discriminatory attitude of the BSNL Management wherein Management has issued order for payment of all the allowances and pay fixation order to un-absorbed ITS Officers as per 6th CPC recommendations.
CMD after hearing all the representatives of Forum accepted that they don't have much to discuss today but the demands of Forum can be accepted, only when the company's financial health improves, till the time employees should have patience.
Forum leaders categorically told that since BSNL Management is giving all 6th CPC benefits to non-optee ITS Officers and providing vehicles (SWIFT Dzire, Maruti SX-4, Honda City etc.) then how management is pleading financial implications for BSNL absorbed employees.
Hence, Forum of BSNL Unions/Associations after CMD's Meeting in its meeting decided to continue proposed agitation programmes i.e. DHARNA on 6th June'2012 and Indefinite strike w.e.f. 13th June'2012 .
All the CHQ Office bearers, Circle/Branch Secretaries are requested to ensure successful implementation of Forum's agitation Programmes.

18.05.2012: STATUS OF ITS OFFICERS ABSORPTION ISSUE: Hon'ble High Court, Delhi outrightly dismissed the modification application filed by BSNL seeking 25 months time for repatriation of unabsorbed ITS officers working in BSNL.Even desperate plea made by the BSNL counsel to give time upto 31st December, 2012 was rejected by the Hon'ble Court. Hon'ble HC while dismissing the application of BSNL directed it to complete repatriation process by 30th Sept, 2012.
Intervention application was filed by AIBSNLEA, BSNLEU and SNEA(I). Even though the intervention application was also dismissed, yet counsel appearing for these Associations/unions strongly opposed the move of ITS controlled BSNL Management for extension of time. Intervention application was not admitted on technical grounds since we are not party in the original application.
Further course of legal action is being discussed with our counsel.
17.05.2012: GS, AGS(HQ) met Sr. GM(Pers.) and extended sincere thanks for getting the approval of BSNL MC to fill up 414 DGMs posts by DEs, giving one time relaxation in the eligibility criteria as per BSNL MSRRs and requested to expedite DPC. Sr. GM(Pers.) appreciated our concern and informed that shortly Pers. Cell is submitting application for clarification to Hon'ble High Court Ernakulam Kerala for 147 SDEs (of LDCE quota) inclusion or deletion as per the Hon'ble CAT Ernakulam judgement. The case is coming for hearing on 22nd May'2012.
(b) DPC from JTO to SDE(T): We requested to expedite DPC from JTO to SDE. Sr. GM(Pers.) mentioned that the Circles have been asked to sent JTOs corrected Circle gradation list at the earliest to finalize the JTOs seniority list on All India basis and thereafter DPC will be completed.
17.05.2012: JAC meeting with CLC: GS, President along with JAC Members attended the meeting with Chief Labour Commissioner (CLC) in his office and discussed the demands of JAC raised during 15th December'2011 Strike. In the presence of PGM(SR), GM(Estt.), DGM(SR), AGM(SR) and other senior officers of CLC the JAC demands on VRS and repatriation of ITS Officers were discussed in detail. Remaining demands will be discussed on 30.05.2012 in CLC Office. 18.05.2012: STATUS OF ITS OFFICERS ABSORPTION ISSUE: Hon'ble High Court, Delhi outrightly dismissed the modification application filed by BSNL seeking 25 months time for repatriation of unabsorbed ITS officers working in BSNL.Even desperate plea made by the BSNL counsel to give time upto 31st December, 2012 was rejected by the Hon'ble Court. Hon'ble HC while dismissing the application of BSNL directed it to complete repatriation process by 30th Sept, 2012.
Intervention application was filed by AIBSNLEA, BSNLEU and SNEA(I). Even though the intervention application was also dismissed, yet counsel appearing for these Associations/unions strongly opposed the move of ITS controlled BSNL Management for extension of time. Intervention application was not admitted on technical grounds since we are not party in the original application.
Further course of legal action is being discussed with our counsel.
17.05.2012: GS, AGS(HQ) met Sr. GM(Pers.) and extended sincere thanks for getting the approval of BSNL MC to fill up 414 DGMs posts by DEs, giving one time relaxation in the eligibility criteria as per BSNL MSRRs and requested to expedite DPC. Sr. GM(Pers.) appreciated our concern and informed that shortly Pers. Cell is submitting application for clarification to Hon'ble High Court Ernakulam Kerala for 147 SDEs (of LDCE quota) inclusion or deletion as per the Hon'ble CAT Ernakulam judgement. The case is coming for hearing on 22nd May'2012.
(b) DPC from JTO to SDE(T): We requested to expedite DPC from JTO to SDE. Sr. GM(Pers.) mentioned that the Circles have been asked to sent JTOs corrected Circle gradation list at the earliest to finalize the JTOs seniority list on All India basis and thereafter DPC will be completed.
17.05.2012: JAC meeting with CLC: GS, President along with JAC Members attended the meeting with Chief Labour Commissioner (CLC) in his office and discussed the demands of JAC raised during 15th December'2011 Strike. In the presence of PGM(SR), GM(Estt.), DGM(SR), AGM(SR) and other senior officers of CLC the JAC demands on VRS and repatriation of ITS Officers were discussed in detail. Remaining demands will be discussed on 30.05.2012 in CLC Office. (a) Mass transfer of executives in Bihar Circle- our protest against: We strongly protested against the mass transfers(36 out of 108) of DEs (including Officiating promotions), which is involving huge wasteful expenditure. CGMT Bihar Circle has told that BSNL have sufficient fund to meet the expenditure incurred in mass transfers whereas large number of employees claims are pending in Bihar Circle due to non-availability of funds. United Forum is on agitation programme since 9th May'2012 against these mass transfers & indifferent & harassing attitude of CGMT, Bihar Circle. Director (EB) after detailed discussions assured to look into the matter.
(b) Modifications in BSNL Executives transfer policy- our protest against: We expressed our serious concern against increasing the tenure of transfer period of soft tenure station from two years to three years which contradicts to the Govt.'s transfer policy provisions as well as against Para II (d) i.e. "the Executives being posted in Soft Tenure from within the Circle may not be allowed to revert to the same SSA from where they were transferred, at least for one post tenure" which has defeated the very purpose of dealing with soft tenure stations. Director (EB) after discussions assured to re-examine the issue.
(c) DPC to fill up vacant DGM(Engg.), DE(T), SDE(T) & DGM(Fin) posts: We requested Director(EB) to get approval of MC for filling up of DGM(Engg.) & DGM(Fin) vacant posts as well as to hold DPC to fill up vacant DEs posts on regular/adhoc basis. Similarly to fill up all vacant SDEs posts. Director(EB) assured to look into the matter.

10.05.2012:GS, President & AGS (HQ) met GM(Estt.) and discussed
a) Finalization of JTOs gradation list for TES Group -'B' Promotion: We requested that after delivering of the court judgement by Hon'ble CAT Chennai on finalizing the JTOs gradation list on the basis of year of recruitment. The necessary direction is to be issued to all Circles for preparing the JTOs Circle gradation lists and to sent to BSNL CO Pers. Cell for preparing the JTOs eligibility list and to hold DPC to fill up about 3500 vacant SDEs(T) posts. GM(Estt.) appreciated our concern and assured that by tomorrow the Court direction will be uploaded on BSNL CO site and it will be sent to Sr. GM(Pers.) for further necessary action.
b) Pay anomaly case of Departmental JAOs: We requested to clear the pay anomaly case of departmental JAOs processed by PAT Cell. GM(Estt.) informed that a committee has been formed headed by PGMSR), Sr. GM(Pers.), GM(Estt.), GM(EF) and GM(FP) are the members for the same and the meeting of the said committee will be held on 18th May'2012. He assured that soon the Committee will reach to some conclusion to resolve the issue.
c) Regularization of Officiating JTOs: We enquired about today's proceedings of Hon'ble High Court Chandigarh in JTOs case. GM(Estt.) informed that the case is now posted for hearing on 30th July'2012 in lieu of demanding Hon'ble High Court Ernakulam Judgement copy on this issue.
d) Court Case against creation of super-numeric posts of JTOs and allowing these JTOs in LDCE-2012: Com. GS briefed about the court case filed by some executives in the Hon'ble High Court Chandigarh against creation of 3500 super-numeric posts of JTOs and allowing them to appear in the TES Group-'B' LDCE-2012, wherein applicants have requested that since creation of 3500 super-numeric posts are under litigation so the LDCE conducted is illegal, hence it should be cancelled and LDCE result should be stayed. Hon'ble Court has admitted the case and the next date of hearing is posted on 17th May'2012. GM(Estt.) immediately discussed the matter with Addl. GM(Estt.) and AGM for filing immediate reply and assured to look the matter personally.
e) Restructuring of AD(O/L) Cadre:- We requested to speed up the Committee work looking on Restructuring of AD(O/L) Cadre. GM (Estt.) informed that today meeting of the Committee headed by Addl. GM(Estt.) was held. He assured to discuss the matter with Addl. GM(Estt.).
f) Anti-dating of DNI wherein seniors are drawing less pay then juniors: We requested to settle long pending issue of anti-dating of DNI wherein seniors are drawing less pay then juniors. GM(Estt.) mentioned that yesterday only he has discussed the matter with AGM(PAT) and assured an early decision on this issue.
g) Conciliation Proceedings by CLC: The conciliation proceedings will be started by the Chief Labour Commissioner (CLC) on the December 15 strike w.e.f 17th May'2012 with JAC.

In some cases i.e. JTO to SDE(T) DPC can now be conducted since court case is cleared, DE to DGM DPC is held up due to 147 SDEscase and the judgement from Hon'ble High Court, Ernakulam is awaited on 22nd May'2012 but SDE to DE promotion some court cases are still creating hurdles for that any way out, if any, can be suggested by the associations so that an early action can be taken to hold DPC.
(b) Consideration of pending request / tenure transfers of SDEs/DEs: We informed that in most of the Circles transfer request register is maintained and if such practice is started at BSNL Corporate Office and same is uploaded on the website for transparency, the transfer / posting issue will be smoothened. Sr. GM(Pers.) discussed the matter with AGM(Pers.) to smoothen the process. However, he assured that issue will be examined to start such practice in near future.
(c) Modifications in BSNL Executives transfer policy- our protest against: We expressed our protest against increasing the tenure of transfer period of soft tenure station from two years to three years which contradicts to the Govt.'s transfer policy provisions as well as against Para II (d) i.e. "the Executives being posted in Soft Tenure from within the Circle may not be allowed to revert to the same SSA from where they were transferred, at least for one post tenure" which has defeated the very purpose of dealing with soft tenure stations. In this manner these soft tenure stations will continue to suffer with shortage of executives/staff. Hence, this order need immediate modification. Sr. GM(Pers.) after detail discussions assured to look into the matter.
(d) Restructuring of AD(O/L) Cadre: Sr. GM(Pers.) informed that today the Committee on this issue is meeting. He assured to discuss the matter with Addl. GM(Estt.), Chairman Committee for an early action.

There cannot be two procedures under the same rules. We wait to prove the inactive and inefficient administration of Accounts Head and see that this attitude will be changed otherwise the head will be changed.

ITS ABSORPTION - BSNL SHOULD IMPLEMENT THE HIGH COURT ORDER

The judgement of the Delhi High Court for a final disposal of the ITS absorption issue is welcome. For at least the last 5 to 6 years, the issue has been continuing without any final settlement. This has seriously and adversely affected the development and expansion of the company in an unprecedented manner. The company is in loss for the last three years and the top management is answerable. Along with the anti-PSU policy of the government, the uncertainty about the future of the ITS has demoralised the top officers to a very large extend which had its own repercussions in the functioning of the BSNL. This situation can not continue, if the BSNL has to survive.
It is informed that the BSNL management is trying to approach the Court to get more time for the repatriation, on the plea that the services of these officers are indispensable. Similar was the argument by the Britishers that Indians can not rule the country on their own. It is only a fragile argument. There are sufficient ITS officers who have opted for BSNL who can be posted in the important posts. Even if more is necessary, senior and efficient executives can be posted. The Pitroda committee recommendations in this connection is relevant. Less than 100 senior officers are sufficient to man these posts.
The BSNL management should stand for the company from which they get their salary and not for those who want to leave the company for their career prospects. We don't have anything against the ITS officers who want to get repatriated for better prospects. The issue is very simple. If they want BSNL, BSNL wants them. If they do not want BSNL, naturally BSNL also do not want them.
The BSNL Management has to rise to the occasion and has to settle the issue in the interest of BSNL. Any lapse on this will never be condoned or pardoned by the workers or the people of this country who want BSNL to survive and serve the people.

He also assured to get the approval of Management Committee to fill up vacant DGM (Fin) posts. However, he assured for an early action to fill up all vacant DGM, CAO and AO posts.
(b) Consideration of request/tenure transfers of AOs/CAOs/DGMs (Fin): We requested for consideration of request/tenure transfers of AOs/CAOs/DGMs (Fin). Director(Fin) assured an early action in this regard.
(c) Affairs of TN Circle, wherein GM(F) is indifferent to the executives: We expressed our serious concern against the indifferent attitude of GM(F) towards BSNL executives. Director(Fin) assured to look into the matter.

Director(Fin) immediately spoke to Sr. GM(Fin) Kerla Circle to fill up the vacant posts of AO/CAO/DGM(Fin) on local officiating basis without issuing mass transfers.

KOLKATA: State-run Bharat Sanchar Nigam Ltd (BSNL) andMahanagar Telephone Nigam Ltd(MTNL) are likely to file for review of a Delhi High Court order to relieve all Indian Telecom Service (ITS) officers who want to return to the Department of Telecommunications by May 14.
"Both telcos are likely to seek more time from the court on the grounds that relieving so many ITSofficers at a single stroke would rob them of their senior managers and ring in an organisational collapse," two executives aware of the development in BSNL and MTNL told ET.
The decision was taken after Additional Solicitor General AS Chandiok said that the government would have to heed the high court order and accept back all ITS officers in BSNL and MTNL who wish to return within two weeks of these executives exercising their option.
Last week, the government had sought Chandiok's legal advice since there were no vacancies in DoT to absorb so many BSNL and MTNL officers belonging to the ITS cadre.
On April 17, the court had asked these ITS officers to take a final call by April 30 and it is believed nearly all have opted to return to government service where the pension benefits are higher. More so, since they would lose out nearly seven years of central government pension if they opted to be remain in either BSNL or MTNL as the high court has fixed August 12, 2005, as the absorption date.
"After the BSNL and MTNL chairmen received internal feedback that nearly all ITS officers have opted to return to DoT, they urged telecom minister Kapil Sibal to protect the central scale pension benefits of all these executives in a last ditch bid to stop an exodus of their top managers," said a senior BSNL executive who did not wish to be named.
At present, there are nearly 1,700 ITS officers, of whom nearly 1,400 were deputed to BSNL 12 years ago when the telco was spun off into a separate corporate entity from the telecom department. The balance 300-odd have been on deputation in MTNL since the formation of the telco in 1986.
Last November, when the communications ministry gave these officers an option to return to government service, a majority opted to return to DoT. Last month, the Delhi High Court detected glitches in this repatriation exercise and asked all ITS officers to exercise a fresh option by April 30.
After DoT's legal advisors confirmed that neither BSNL nor MTNL would be able to hold on to the remaining 1,300 ITS officers following the court order, both telcos have decided to seek a review of court verdict.

But in the interest of BSNL's growth and its executives, stalemate should be broken and promotion to eligible executives should immediately be given. Sr. GM(Pers.) after detail discussions directed concern officers to immediately seek the clarifications from the Hon'ble courts as well as legal opinion so that DPCs can be held to fill up vacant DGM/DE posts. However, he suggested that Association should also give its clear view to resolve the problem in writing.

Sr. GM(Pers.) apprised the status of Hon'ble Chennai CAT & High Court direction in this regard. DECISIONS TAKEN IN THE JAC MEETING HELD ON 25th APRIL 2012:
A meeting of the Joint Action Committee (JAC) was held today, 25th April 2012. Com. G.L. Jogi presided. GS and President, AIBSNLEA attended the meeting. Com. V.A.N. Namboodiri, Convener, welcomed all the members and also briefed the meeting about the developments after the last meeting. After detailed discussions, the following decisions were taken:
1. ITS absorption and other issues raised in the 15th December strike: The issues raised during the 15 December Strike are yet to be settled. The developmental issues have also not been settled. The ITS issue stands as it is. The meeting expressed strong protest in the delay in settlement. The meeting decided to meet the CMD urgently and all these issues should be aggressively pursued for settlement. A memorandum detailing the issues will also be presented. It was also decided to meet the Secretary, DOT as well as the Communications Minister on these issues. JAC will meet immediately after the meeting with CMD.
2. Concilliation Proceedings by CLC: The conciliation proceedings started by the Chief Labour Commissioner on the December 15 strike issues is yet to hold further meetings for the last few months. It was decided to write to the Secretary Labour and Labour Minister against the non-holding of the conciliation proceedings.
3. Customer Delight Year: The meeting felt that we have to continue the programmes to improve the services and decided to extend the 'Customer Delight Year' for one more year.
4. Affiliation of new unions to JAC :It was unanimously decided to grant affiliation to (1) NFTBE (General Secretary Com.R.K. Kohli) and (2) FNTOBEA (General Secretary Com. P. Andiappan) to the JAC.

12-04-2012: Dear Comrades! Yesterday we met our CGM and discussed about the pending issues and he suggested to meet the GM(F) to remind those issues we raised. But in the middle of the meeting since the alert on earthquake was given we had to suspend the meeting and came out. So we met the GM(F) today. Com.Ravi, FS, Com.Durai, ACS, Com.Guru ACS, CP and CS met GM(F). The atmosphere was so smooth and cordial. We gave a letter with all details on issues to be settled. The letter to CGM given yesterday and to the GM(F) today were given below. We hope issues will be settled smoothly though there may be some delay in proceesing.

17.04.2012:Start making profit, Sibal tells BSNL
Bharat Sanchar Nigam Ltd (BSNL), that is facing stiff competition from private players, has been asked by Communications and IT Minister Kapil Sibal to come up with projects that would help it write off losses and start making profit.
“I have asked BSNL to submit plans for five projects in the next four to six weeks which will help the company to move towards profitability,” Mr. Sibal told journalists on Monday after inaugurating BSNL's new Internet Data Centre (IDC), set up in collaboration with Dimension Data, in the adjoining township of Faridabad.
“Though BSNL has a net worth of Rs.86,000 crore, it incurred a loss of Rs.6,000 crore… that is something that needs to be changed.”
Due to its falling market share, the BSNL has seen its losses shooting up over three times, from Rs.1,823 crore in 2009-10 to Rs.5,997 crore in 2010-11. The company had clocked a net profit of over Rs.10,000 crore in 2005-06, but since then its financial performance has been declining.
A committee formed by Prime Minister Manmohan Singh and headed by his advisor Sam Pitroda had given several suggestions, including voluntary retirement scheme for the overstaffed company, public issue, expansion of mobile business and proper use of towers and land resources. The report is yet to be implemented.
Talking about the data centre, Mr. Sibal said the public-private initiative would leverage the strength of BSNL in telecom infrastructure and help generate revenues. “These IDCs will enhance BSNL's comprehensive service portfolio to meet the communications and IT needs of large, medium and small business enterprises in India. It will facilitate various organisations to quickly induct IT-enabled services within their organisations without the hassle of setting up and maintaining their own data centres.”

DoT panel sees merit in merger of BSNL, MTNL
New Delhi, April 11: Decks have been cleared for the merger of BSNL and MTNL.
The Department of Telecom has told the Parliamentary Standing Committee on Information Technology that the proposal to merge BSNL and MTNL makes sense.
A team of DoT officials, including the Secretary, Mr R. Chandrashekhar, who appeared before the panel on Wednesday, said the Board for Reconstruction of Public Sector Enterprises' (BRPSE) recommendation that MTNL could be brought under BSNL was accepted by a committee set up by the DoT.
The DoT told the panel that the board's recommendation was examined by a committee headed by Member (Services) of the Telecom Commission. The committee, officials said, has submitted its report.
“The committee has recommended that while the merger of BSNL and MTNL prima facie makes sense, merger with or takeover of Indian Telecom Industries (ITI) by BSNL, reflects a poor business case for sustainable viability of ITI with no significant tangible benefits to BSNL,” a Standing Committee member said quoting the officials.
The BRPSE had earlier said that there was no reason for MTNL to continue as a separate entity. The DoT's panel, which looked into the issue of merger, has also raised issues such as difference in pay scales and HR policies.
“The committee has further recommended that though the merger of BSNL-MTNL is desirable, the issues such as differences in pension administration mechanism, difference in pay scales and other HR policies of the two organisations need to be resolved first before moving ahead,” the officials told the standing committee.
Synergistic alliance They added that since resolving of such issues are time consuming, the DoT has decided to encourage “creation and recognition of synergistic alliance” of the BSNL and MTNL through policy interventions.
The officials added that the report of the DoT committee has been sent to the BRPSE for its consideration after the approval of the competent authority.
The Standing Committee has started examining the demands for grants of the DoT for this fiscal.
The report of the panel will be laid in the second part of Budget session, which will begin on April 24.

12.04.2012 : Security on the wire
The Chinese ghost is back to haunt the telecom sector. This time it is over equipment that a private operator has contracted to buy from Huawei Technologies and ZTE Corporation financed by loans from state-owned Chinese banks. India's external intelligence agency, the Research and Analysis Wing, has pointed to Huawei's links with the People's Liberation Army of China in an apparent objection to the import deal. To be sure, this is not the first time that Chinese telecom companies are in the news for the wrong reasons. A couple of years ago, state-owned BSNL was forced to cancel a contract awarded to these same companies following objections raised by security agencies. The concern was that foreign agencies could take control of the communication network during a hostile situation through embedded software, or use it to snoop on India. The government then placed an informal ban on imports of telecom gear from China and when the operators protested, it allowed such imports subject to guidelines, one of which was that the supplier should submit the source code for the embedded software.
Let's get this straight. If the concern is over security of imported telecom equipment, it cannot be about any one country or company. The two Chinese companies in question may have links to that country's security agencies but arguably, equipment sourced from any other company or country can be bugged too. Worse, if they so wish, foreign security agencies can even try and bug networks in India that are already running. It is not necessary that they have to do it only when equipment is bought from their country. Faced with such risks, the government has two options. One, it can ban telecom gear imports and direct operators to source all such equipment from within India. But that will be knee-jerk and is a sure fire method to put down the booming telecom industry of the country. The second and more pragmatic option is to develop counter-measures aimed at containing precisely the threat that the intelligence agencies are concerned about. The government should prod these agencies into investing in technology to deal with such threats rather than seeking a ban on imports, which is all too easy and convenient an option. Simultaneously, it should involve the telecom industry in a dialogue to devise a comprehensive policy on equipment imports without compromising on the country's security. Operators go to China for its cheaper prices and easy availability of finance which in turn helps them to offer low tariffs for their services. The government should bear this in mind while framing its policy.
